Public displays by the reallocation office
Due to the amendment to the Administrative Procedure Act (VwVfG) that took effect on January 1, 2024, documents that must be made available for public inspection pursuant to a legal provision, as provided for in Section 27b, must be posted on the website of the competent authority.
In the context of a land readjustment proceeding under § 45 et seq. of the Building Code (BauGB), this includes the inventory list and the inventory map, both of which are made available for public inspection after the proceeding has been initiated. As the name aptly describes, they contain the current status of the procedure area with regard to land ownership (ownership, land registry entries, and information from the real estate cadastre).
Since the inventory list contains confidential information regarding ownership data pursuant to Section 30 of the Administrative Procedure Act (VwVfG), the publication lists the so-called reference numbers assigned to the respective owners in the proceedings instead of their names.
The public review is conducted in accordance with § 53 (2) of the German Building Code (BauGB) for a period of one month and is announced in the Amtsblatt of the State Capital of Mainz in the manner customary for the locality.
