You can apply for and extend a residence permit for the purpose of employment at this link.
As the holder of a Mobiler ICT card, you can apply for its renewal under certain conditions.
What do I need to know?
Service description
You can renew a Mobiler-ICT card if you wish to continue working as a manager, specialist, or trainee in a German branch of your company.
The requirements for renewal are essentially the same as those for the initial issuance of the Mobile ICT Card, in particular that you can cover your living expenses and health insurance without recourse to public benefits.
The Mobile ICT Card is generally issued for the duration of the intra-corporate transfer. However, the total length of stay in Germany may not exceed three years for executives and specialists and one year for trainees. At the same time, the planned stay in Germany may not be longer than the stay in the EU member state that issued you the residence permit for the purpose of intra-corporate transfer.
As a rule, the Federal Employment Agency must approve the continuation of employment. Approval is obtained by the immigration office.
Prerequisites
In principle, you must meet the same requirements for renewing your Mobiler ICT card as you did when it was first issued, i.e.:
- You have a recognized and valid identity document (e.g., passport or passport substitute).
- You have a residence permit from another member state that is valid for the entire duration of the procedure for the purpose of intra-corporate transfer.
- Your company or group of companies has its headquarters outside Germany and wishes to continue to employ you as a manager, specialist, or trainee in a branch in Germany.
- The transfer lasts longer than 90 days in total, but less than your period of residence in another EU member state.
- You can present an employment contract valid for the duration of the transfer and, if necessary, a letter of secondment.
- The Federal Employment Agency has approved the employment (approval is obtained by the immigration office) or there is an exemption from the approval requirement for the intended activity.
- You can cover your living expenses and health insurance from your income without claiming public benefits.
- The conditions under which you will work in the future are comparable to those of German employees.
- Your wages correspond to those of German employees.
- There is no interest in deporting you.
- Your stay does not jeopardize or impair the interests of the Federal Republic of Germany.
Procedure
- Find out whether your immigration office allows you to apply online or provides a special application form.
- If you can only apply in person, make an appointment with the immigration office. If you apply online, the immigration office will contact you after receiving your application to arrange an appointment.
- During the appointment, your identity and documents will be checked (please bring your documents, preferably the originals, with you to the appointment).
- If your application is approved, your fingerprints will be taken for the production of the mobile ICT card (issued in the form of a new electronic residence permit, or eAT card for short). The immigration office will commission the production of the mobile ICT card from the Federal Printing Office. Once it is ready, you will be notified and can pick up the card at the relevant office. The card must always be picked up in person.
- If your application is rejected, you will receive a rejection notice.
What else should I know?
- The MobilerICT card will not be issued if the foreign national will be staying in Germany for longer than in other EU member states as part of an intra-corporate transfer.
- The ICT card is issued in all EU member states except Denmark, the United Kingdom, and Ireland. It is therefore not possible to enter these countries with an ICT card.
