The Lower Immission Control Authority protects people and the environment from harmful environmental impacts. The main task of the Environmental Noise Directive is to reduce noise pollution for the population. Exposure is determined using strategic noise maps and noise action plans are drawn up to reduce and prevent noise.

The Environmental Noise Directive 2002/49/EC of the European Parliament and of the Council of June 25, 2002, provides a framework for the assessment and management of environmental noise. The main objectives of the directive are to reduce noise pollution for the population. The exposure is determined by strategic noise maps and noise action plans are drawn up to reduce and prevent noise.

The directive was transposed into federal law with the amendment of the Federal Immission Control Act of June 24, 2005 (Federal Law Gazette I p. 1865 - § 47 a-f BImSchG) and the Ordinance on Noise Mapping of March 6, 2006 (BGBl. I p. 516 - 34. BImSchV).

Special permits for events

The period from 10 p.m. to 6 a.m. is considered nighttime quiet hours. The legal basis for this is the State Immission Control Act (LImschG). The protection of quiet hours is regulated in § 4. Exceptions to this prohibition are only permissible if the disruptive nighttime activity is in the public interest or in the overriding interest of a party involved.

Typical examples of activities in the public interest are recurring maintenance work on tracks belonging to private or public transport facilities. Predominantly special private interests include, for example, public festivals, weddings, milestone birthdays, or similar events.

An application for an exemption can be submitted to the Parks and Environment Office. Large events of city-wide significance are handled by the Structural and Approval Directorate South. Applications for exemptions must generally be submitted one month before the start of the event. The relevant application form is available from the Parks and Environment Office.
